James Taylor t/a Vitality Creation Decor

  1. “We”, “Us” and “Our” means James Taylor trading as Vitality Creation Decor and “You” means the person or persons asking Us to carry out work and/services for You and ”the Work” means the work and services identified in Our quote.
  2. When We offer Our services You agree that these terms and conditions are incorporated into the agreement to carry out the Work unless they are amended, excluded or otherwise modified in Our quote to You.
  3. If You accept Our quote for the Work offered to You:
    • You must accept Our quote within 28 days;
    • We will carry out the Work for the price stated on Our quote;
    • You will pay Us in accordance with the arrangements for payment or payments set out in Our quote.
  4. We agree to carry out the Work to a good and workmanlike standard and to leave your premises clean and tidy (unless they are not clean and tidy at the onset of the Work) and free of Our materials.
  5. You agree:
    • to remove furniture, valuable, heavy or bulky items from an area where the Work is being carried out. We may agree to help you move some items unless there is a risk of injury or damage but You must ensure that We can work in a safe environment and without risk of damage to Us, your premises or items.
    • to “drop” all radiators if the area behind is to be fully decorated or accept that We can only paint or wallpaper accessible parts.
    • To isolate electrical outlets if We require.
    • to remove or cut back vegetation, trees, shrubs or plants to enable access to external areas if required or part of the Work.
    • to provide heat, water and electricity to enable us to work in a reasonable environment or if We need to use water or power.
    • to provide access to Us and our materials on any date or dates agreed and that Our materials may remain at your premises whilst We carry out the Work.
  6. These terms and conditions can only be amended if evidenced by agreement in written communications between Us.
  7. We do not warrant that any manufacturer’s claims for their materials will apply to the Work, but we will recommend good quality materials and apply them in accordance with the manufacturer’s guidelines.
  8. Our quote is given on the basis that walls and ceilings are sound and free of defects, mould and damp and that timber is sound and free of rot/decay, infestation and structurally sound. We give no warranties or representations that your premises are free of any defect of whatever nature that would be discovered by a detailed survey. Our quote does not include work required to bring plastering, surfaces or timber to a good and sound condition unless We agree in our quote.
  9. If You do not pay Us the manner set out in Our quote You will owe Us interest at 10% on those monies until We receive them. Unless we confirm otherwise in Our quote, monies are due to Us when We complete the Work.
  10. If You cancel or prevent us from starting or carrying out or completing the Work:
    • You will pay Us a reasonable sum for such part or parts of the Work that We have carried out and payment in full for all materials paid for by Us at your request and in addition You will pay Us 50% of the remainder of the price in Our quote if You cancel the Work after it has been started.
    • You will pay Us 25% of the price in Our quote if you do not provide Us with at least 28 days prior notice in writing that the Work is not to be carried out.
    • You will pay Us a sum of £250 for each day or part day’s delay in Our being able to carry out the Works if that delay is caused by You.
  11. If You do not make a payment to Us as required by Our quote We reserve the right not to carry out or continue the Work and to remove Our materials until You do and We agree to continue the Work. If You wish to discuss the Work or Our services when the Work has commenced You must notify Us as soon as possible and meet where the Work is being carried out with Us at Our request.
  12. We reserve the right to take photographs of your premises both before and after commencement of the Work for marketing purposes and/or to record the state and condition of the same.
  13. All materials purchased for You belong to James Taylor t/a Vitality Creation Decor at all times until You have paid Us in accordance with these terms and conditions and Our quote and if We use your materials at your request You cannot hold us responsible for their suitability or performance.
  14. We will retain your details to carry out the works or for marketing purposes but will not sell them to any 3rd party.
